These Terms of Service ("Terms") govern your download of, access to, and use of the Bucketly desktop application, website, accounts, subscriptions, updates, and related services (together, the "Services"). The Services are provided by Shogun Dot Dev (Pty) Ltd ("Shogun Dot Dev", "we", "us", or "our"), a private company incorporated in the Republic of South Africa under registration number 2025/181300/07.
By creating an account, purchasing a subscription, downloading, installing, or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services. If you use the Services for an organisation, you confirm that you have authority to bind it to these Terms.
You must be at least 18 years old and legally capable of entering into a binding agreement. You must provide accurate account information, keep your sign-in credentials confidential, and promptly notify us at [email protected] if you suspect unauthorised access. You are responsible for activity carried out through your account unless caused by our breach of these Terms or applicable law. Some features may be available in guest mode without an account.
Bucketly is a locally installed client that lets you connect to and manage third-party S3-compatible storage services. At your direction, it can list, upload, download, edit, move, make public, or delete objects and perform other storage operations. We do not host or take custody of the files in your storage account merely because you use Bucketly.
Your storage provider, Google sign-in, and other third-party services have their own terms, privacy practices, charges, availability, and security requirements. You are responsible for maintaining the necessary rights, permissions, credentials, backups, and provider account. We are not responsible for a third-party service or for an action it takes, but this does not exclude liability that applicable law does not allow us to exclude.
We may change paid pricing or plan composition prospectively. We will provide reasonable advance notice where the change affects an existing recurring subscription, and the change will take effect no earlier than the next renewal unless applicable law or the checkout terms require otherwise.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use Bucketly on devices you own or control for your personal or internal business purposes. You may not sell, sublicense, rent, redistribute, or commercially exploit the Application; remove proprietary notices; circumvent licensing or security controls; or reverse engineer, decompile, or disassemble it except to the limited extent that applicable law expressly permits despite this restriction.
You must not use the Services to:
As between you and us, you retain your rights in your storage content and connection configuration. You instruct Bucketly to perform operations through your provider credentials and are responsible for reviewing commands before confirming them. Storage operations, particularly deletion, overwrite, public-access, and bulk operations, may be irreversible. Keep independent backups and use credentials with the least permissions reasonably necessary.
The Services, software, designs, documentation, trademarks, and related intellectual property belong to or are licensed to Shogun Dot Dev. These Terms do not transfer those rights to you. If you send us suggestions or feedback, you grant us a worldwide, perpetual, royalty-free right to use them to operate and improve our products, without identifying you publicly or overriding your rights in personal information.
We may release updates, security fixes, or new versions and may stop supporting older versions. Features identified as alpha, beta, preview, or experimental may be incomplete, change without notice, or contain defects. Do not rely on pre-release features as the sole means of storing or protecting important data. We do not promise uninterrupted availability or compatibility with every provider, device, operating system, or third-party change.
Sections 11 to 13 limit warranties and liability and allocate risks to you, including risks of data loss and third-party storage operations. Please read them carefully before using or purchasing the Services. These provisions apply only to the extent allowed by law and do not remove mandatory consumer rights.
To the extent permitted by law, the Services are provided "as is" and "as available". We do not give warranties that the Services will be uninterrupted, error-free, completely secure, or compatible with every S3 implementation. However, nothing in these Terms excludes any warranty, guarantee, right, or remedy that cannot be excluded under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or other applicable law.
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profit, revenue, goodwill, or data that was not a reasonably foreseeable result of the breach. Where a financial cap is lawful, our total aggregate liability arising from the Services will not exceed the amount you paid for the affected Services during the 12 months before the event giving rise to the claim.
The exclusions and cap do not apply to fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, breach of confidentiality or data-protection duties where liability cannot be limited, or any other liability that applicable law does not permit us to exclude or limit.
If you are a consumer, these Terms must be read subject to the mandatory consumer law of your country or region. In South Africa, this includes applicable rights under the Consumer Protection Act and the Electronic Communications and Transactions Act. A contractual choice of South African law does not deprive you of non-waivable protections that apply where you live.
If you use the Services on behalf of a business, that business will indemnify Shogun Dot Dev and its personnel against third-party claims and reasonable costs arising directly from its unlawful use of the Services, infringement of third-party rights, or material breach of these Terms. This section does not apply to the extent a claim was caused by us, does not require a consumer to indemnify us where prohibited by law, and does not exclude our duty to mitigate loss.
You may stop using the Services at any time and may delete your account through the available account controls. We may suspend or terminate access where reasonably necessary to address a material breach, fraud, security risk, legal requirement, non-payment, or harm to the Services or others. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue. We may discontinue a Service on reasonable notice where practicable. Sections that by their nature should survive termination will continue to apply.
We may update these Terms to reflect changes to the Services, law, security, or our business. We will post the updated Terms and revise the date above. For a material change, we will provide reasonable advance notice through the website, Application, or account email where practicable. If you do not agree to a material change, you must stop using the Services before it takes effect and may cancel any affected subscription.
These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory consumer right to bring a claim elsewhere, the South African courts have jurisdiction. Before filing a claim, please contact us so we can try to resolve the dispute informally. South African consumers may also approach a competent ombud, the National Consumer Commission, or another body with jurisdiction.
If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent, but we may transfer them as part of a merger, reorganisation, financing, or sale of the relevant business, subject to applicable law. These Terms, the Privacy Policy, and any purchase terms presented at checkout form the agreement concerning the Services.
